El Gobierno de Reconciliación y Unidad Nacional informa al Pueblo de Nicaragua y a la Comunidad Internacional que hoy presentó su Memoria en el caso radicado ante la Corte Internacional de Justicia en contra de la República Federal de Alemania en relación al incumplimiento de ciertas obligaciones internacionales con respecto al Territorio Palestino Ocupado (Alleged Breaches of Certain International Obligations in respect of the Occupied Palestinian Territory). Los alegatos escritos de Nicaragua fueron presentados en tiempo y forma según lo requerido por la Corte. 

En su Memoria, Nicaragua demuestra que las violaciones de Alemania datan de décadas atrás, y señala que entre ellas figuran el incumplimiento de la obligación de garantizar el respeto del derecho internacional humanitario, el incumplimiento de la obligación de respetar y promover la realización del Derecho del Pueblo Palestino a la libre determinación, incluida la obligación de no hacer nada para ayudar o asistir a Israel en el mantenimiento de la situación creada por su presencia ilegal y su régimen de discriminación racial, segregación y apartheid en el territorio palestino ocupado, y el incumplimiento de la obligación de prevenir, castigar y no ser cómplice del genocidio.

Nicaragua ha detallado ante la Corte el apoyo político, económico y militar, entre otros, que Alemania ha brindado a Israel y que ha facilitado las violaciones de normas peremptorias del derecho internacional a pesar de las conclusiones de la Corte en sus Opiniones Consultivas de 2004 y 2024, en las que se detallan las consecuencias y obligaciones de los terceros Estados de no ayudar ni asistir a Israel en su conducta ilegal. 

En razón de lo anterior, Nicaragua ha solicitado que Alemania cese su conducta violatoria, incluyendo la detención del suministro de equipo militar, la distinción en sus actividades comerciales, culturales, académicas entre el territorio de Israel y el territorio palestino ocupado, la no repetición de dicha conducta y la reparación para las víctimas palestinas, entre otros.

Nicaragua nuevamente hace un llamado a todos los Países a tomar las medidas concretas para detener el genocidio, el apartheid y los crímenes de guerra, y los llama a cumplir con las normas de Derecho Internacional correspondientes, incluyendo el deber de no reconocer como legítima la situación creada por las ilegalidades cometidas por Israel según lo confirmado por la Corte Internacional de Justicia en sus Opiniones Consultivas de 2004 y 2024. De igual manera, los llama a detener cualquier apoyo militar a fin de evitar el riesgo de que dichas armas se utilicen para violar el derecho internacional según la Ordenanza del 30 de abril de 2024.

Finalmente, Nicaragua desea agradecer el apoyo de todas las y los colaboradores que trabajaron para la presentación de esta Memoria, la cual ha sido presentada en cumplimiento de las obligaciones internacionales de Nicaragua de tomar todas las medidas necesarias para detener las violaciones a las normas más fundamentales del Derecho Internacional en contra del Pueblo Palestino.

El Gobierno de Reconciliación y Unidad Nacional reafirma su firme compromiso con el Estado de Derecho a Nivel Internacional y la solución pacífica de las controversias entre Estados.

The Government of Reconciliation and National Unity informs the people of Nicaragua and the international community that today it submitted its Memorial in the case before the International Court of Justice against the Federal Republic of Germany concerning the Alleged Breaches of Certain International Obligations in respect of the Occupied Palestinian Territory. Nicaragua’s written pleadings were submitted in a timely manner, as required by the Court.

In its Memorial, Nicaragua demonstrates that Germany’s violations date back decades and points out that they include failure to fulfill its obligation to ensure respect for international humanitarian law, failure to respect and promote the realization of the Palestinian people’s right to self-determination, including the obligation not to do anything to help or assist Israel in maintaining the situation created by its illegal presence and its regime of racial discrimination, segregation, and apartheid in the Occupied Palestinian Territory, and failure to prevent, punish, and not be complicit in genocide.

Nicaragua has detailed before the Court the political, economic, and military support, among other forms, that Germany has provided to Israel and that has facilitated violations of peremptory norms of international law despite the conclusions of the Court in its Advisory Opinions of 2004 and 2024, which detail the consequences and obligations of third States not to aid or assist Israel in its illegal conduct.

In view of the above, Nicaragua has requested that Germany cease its unlawful conduct, including the export of military equipment, the distinction in its commercial, cultural, and academic activities between the territory of Israel and the occupied Palestinian territory, the non-repetition of such conduct, and reparation for the Palestinian victims, among other things.

Nicaragua once again calls on all countries to take concrete measures to stop genocide, apartheid, and war crimes, and calls on them to comply with the relevant norms of international law, including the duty not to recognize as legitimate the situation created by the illegal acts committed by Israel, as confirmed by the International Court of Justice in its Advisory Opinions of 2004 and 2024. Similarly, it calls on them to cease all military support in order to avoid the risk that such weapons will be used to violate international law, in accordance with the Ordinance of April 30, 2024.

Finally, Nicaragua wishes to thank all those who worked on the preparation of this Memorial, which has been submitted in compliance with Nicaragua’s international obligations to take all necessary measures to stop violations of the most fundamental norms of international law against the Palestinian people.

The Government of Reconciliation and National Unity reaffirms its firm commitment to the rule of law at the international level and to the peaceful settlement of disputes between States.
